Yep, you may as well just add that into the letter as well. They might try and argue the toss re employed -v- self employed but if you don't try you don't get iyswim.

I know they should be paying, ACAS have told me they are out of order on the leave thing especially
 
the 'best way' to deal with this is write a totally 'functional' resignation letter
(dear manager please accept my notice of resignation , my intended leaving day is xx your sincerely zippy )

and then lay in to manager in a seperate 'leaver's letter' sent to HR
 
I dont see the point TBH. I dont have a problem with him seeing it all and would rather it was addressed to him- as the perpetrator and reinforcer of bad management practices and bullying by him and his staff members
 
Effectively your resignation is a Constructive Dismissal. You were put in the position of having to resign by their practices. If you were a union member you could have put this to the union. I suspect you are not as you would not be in the position of being bullied in that way. Taking an employer to a Tribunal at your own expense is not viable though.

I guess that the complex relationship between you and your employer/agency is the reason that you just could not be represented by a union. I am not having a go. :)

I disagree to a certain extent. It would cost LMHF nothing to do it herself - the costs only start building up if she gets legal/professional advice.

But constructive dismissal cases are notoriously difficult to win, mainly because the burden of proof is on the ex-employee. But not impossible by any means.

And anyway - the threat of potential proceedings is often enough for an employer to settle the dispute because it would inevitably cost them money.

However I do think that it would shake things up for him if I sent the letter VP and Caesare have kindly penned for me:)
 
Having checked with ACAS I am entitled to holiday pay, which they never paid me and never allowed me to take... so They have to pay me that or I can pursue them for it through ACAS and an employment tribunal if necessary
 
ACAS can't pursue it for you LMHF, cos they have to maintain independent status. But if you incorporate it into that letter you're covered re your duty to raise it as a grievance - and if they don't pay it, yes you can take them to an ET.
 
Yes, sorry, I should have been clearer.
When I say "Through" They said they are able to possibly mediate and point out that it has to be paid..not that they would be acting 'for' me as such
 
Yes, that would be useful definitely. Btw, they also get automatically appointed (a conciliation officer) if it does go to ET -- but it's obviously better if you can sort it out before it goes that far.
 
Currently I go to work every day with an up to date resignation letter. If the two faced, back stabbing cow who is my supervisor pisses me off one more time, I can just hand it to her there and then.

Just a question about notice to be given: I have to give a weeks notice, so if I resign today (Monday) is my last day Monday or is it Friday. :confused:
