What would you do...houseshare 'problem'

I've always worked on the basis that the people staying found the new flatmate, as long as enough notice was given. The last thing I would want would be somebody leaving to choose my new housemate

Yeah me too. I don't think it's fair to take his deposit.
 
oh and if your deposit isn't in the DPS scheme, then your landlord is breaking the law, so he could take the landlord to court if he withholds the deposit.

yup, because at the end of the day it'll be you who is liable for the rent, and to live with the person, and ultimately have the right of vito if you don't like who they chose. imo, it's definitely the responsibility of the remaining housemates to sort it out...
 
Surely HE is liable for the rent if it is HIS responsibility to find someone for the room?

Otherwise he could put minimal effort in to get someone else (like he appears to have done) and leave you guys to pay the extra rent.

So yeah, either he pays the extra rent, or he loses his deposit. It's not fair to expect you guys to take up the slack, imo.

Legally, he is liable, but so is everyone else. Once he moves out, he need not be quite so worried about rent arrears on a property he isn't living in. And as far as the landlord is concerned, whether fair or not, his share of any deposit remains his. They're not going to referee. Disclaimer - I am not legally qualified this is just my understanding.
 
if it's a joint tenancy then if everyone apart from one person suddenly disappeared from the house and couldn't be found then that one person left woudl be liable for all the rent! it's a bit shit.
 
imo it's not fair to expect anyone to keep paying after they've moved out, as long as they've given reasonable notice.

you are probably right, it depends on the exact circumstances tho, what has been agreed on. in the shared houses i've been in the people left in the house have always found the new tenant anyway, then the new tenant gives the deposit money to the old tenant (not 100% sure this is fair tho, as what if everyone decides to move out after a few months, then if there's any deductions from deposit from the whole length of the tenancy the new tenant has to cover them!)

i know, it just seems like a very odd way of doing it :hmm:

depends what's in the contract, but there's no harm in appealing to his conscience in leaving his housemates with an empty room they have to pay for.
