I don't see how you are confused - you've just put my point exactly. The outcome is crucial. That's why a tackle which actually shatters a leg in two should rightly be treated differently to a tackle which might look similar but does no damage. Just as a speeding motorist who actually kills someone is (and should be) treated differently to a motorist who simply speeds. After all, there are speeding motorists 'day in, day out'. Is it clear now?
