Wages witheld. URGENT

I know the matter's urgent now cos of needing to pay for stuff - but if you get no joy there's no need to go down the small claims route cos you can just make an Employment Tribunal claim for unlawful deduction from wages. Doesn't cost anything.
Yes, this is good. And a good thing to mention to them to get them to pay. A calm, measured 'if you do not pay me today, I shall be doing this, this and this.' I'd look it up online to find out the exact procedure so that you can tell them that. This may persuade them that it is in their interests to pay.

we've got a number... but the woman at royal mail says this item was not recorded delivery...

its a special delivery reference number... we givev those numbers out free.. we can not tell you where your package is or even if it has been posted.

Both Recorded and Special delivery numbers are 13 characters long (mix of letters and numbers, though I can't remember the order). If you stick it into the Track and Trace box on http://www.royalmail.com/portal/rm. Try putting the number in there and see what it says.

IIRC, you can get rolls of Special Delivery labels, each with a unique tracking number on it. If the number's not yet in their system then it's because it's not been picked up from the post office, which means it's not yet been posted .

Why can't they pay someone who's leaving by cheque? It happens all the time in places I've worked!

A precedent is set, an implied contract between the employer and the employee. To change a payroll amount, date, method of transfer needs the employees' agreement. Puts the employer on a sticky wicket to unilaterally make changes without consultation.

Anyway, seems the OP has more to worry about ie will she get the £$£$ at all! Cheque, cash, carrier pigeon.

that doesnt make sense - why would they give out useless numbers??

It sounds as if it's as I explained above - rolls of Special Delivery labels are given out willy nilly. It's only once RM have received the package / envelope and logged that number on their system that the tracking number becomes "live" IYSWIM.

That link's for appealing against an Employment Tribunal decision though i.e. after a hearing/judgment etc.

Oh bollocks, that's what I get for skimming through it... :o anyway, you're the expert and you're here now so I'll leave it to you!

:D:D I posted the claim link a bit earlier on, if Jasmine needs it. Hopefully she'll be able to embarass them into paying up tbh.

Left work afer just under two months of being there, with a letter of notice.

They sacked me on the spot or accepted my resignation.

Now they are telling me they are paying by cheque, special delivery, they said it would be here by 12. Its not. I've rung royal mail, they said they can not confirm if anyhings been sent out or not,.

I foned my boss. he said. That if it doesnt arrive thats Royal Mail's problem not ours. FUCK WIT!!

I asked him to write another cheque and cancel the old one. He said no! I desperatly need the money as need to eat! And pay my monies for my new room on monday!!! Arrrrrrrgh!

What can i do??

I've thought about going down there to demand my money (peacefully)

Do you think it will work?

or will they just ring the police and have me done for tresspass :(

love you...

ps Jasmine posting x x

THANK YOU

If he claims to have sent it special delivery, phone and ask him for the reference number at the bottom of the special delivery slip so that you can track the letter on-line. If he refuses to give you the reference number, he's lying about having sent it special delivery.

Handed in a weeks notice to be nice and fair and leave on good terms.

He said well you can leave now.

You gave a weeks notice and they told you to leave straight away, right?

Are they paying you for the week that you were prepared to work? I think you should be entitled to pay in lieu of notice which is tax free!

Yeah, I thought it's not that unusual...

If someone leaves, they need to delete them from the payroll system. They usually need to work out holiday pay due/to be deducted, any overtime, the pro-rata amount if only part of a month is worked... so it's often done as a one off calculation followed by cheque... not outrageous or dodgy at all, a fairly normal practice.

Just to let you know....

We went down there. they gave us her payslips and a copy of the cheque, which is now waiting to be picked up at the post office. :)

Only just seen this, but yey! :)

MissusDK, we need to talk about Wales! (which I'm assuming is left too late now but if not... :))
