I think Virgin's defence is going to be: you can still download unlimited amounts, it's just that your speed will be slower if you do it in peak times, so they are still providing you with up to 20Mb unlimted broadband.

Personally I would have preferred being given the choice of traffic shaping, or a fixed amount of monthly DL bandwidth that I could choose to download at a time of my own choosing.
