I also wonder whether this sort of attack can be prosecuted in the way that more traditional DDoS attacks are.

After all, when a DDoS attack uses a botnet or some actual hacking, the perpetrator can be subject to various laws against that sort of thing, and against DDoS in general.

But if all you do is send out an email with a link in it, and the DDoS comes from millions of individuals clicking on that link, that's something quite different, isn't it?

of course the "perp" is not going to be sending out the spam. His botnet is. Reading the headers of spam is a pointless exercise, all you will find is some dick that didn't patch their computer running a command and control trojan.
To get any kind of results for this type of investigation you have to collate all known information.

Would not surprise me to find out if this was done using the fastflux botnet which, if you have the right money, you can use for whatever you want.

At risk of turning this into an old school fanboy argument can you guess what is the singular common feature of the machines on the fastflux botnet?
