Simon Singh vs quack chiropractors: important legal case

So we've got Lord Cheief Justice Lord Judge and Lord Justice Laws?

I reckon that any senior judge who gets appt to the Lords' bench should have to change their names to these by deed poll for the time they're sitting :D

My mate's taken the day off to go to the court and hopefully hear the case. And probably to tell Singh how fabulous he is, he's such a groupie

However, I'm quite exctied and hope to be getting regular updates as it progresses. Gonna be a massive milestone case regardless of the final outcome. Though it'd be nice if it were a good outcome, like! :)

That's an absurd requirement for a thing to be described as bogus, anyone can believe their own line of bullshit and provide insufficient evidence for it. Judge is clearly an utter moron.

Just so I'm following this correctly, is the outcome more to do with Singh's right to offer opinion rather than any judgement over the accuracy of his claims?

This is excellent news :).

Presumably the BCA will now have to bear the full costs -- doesn't seem to specify on either the BBC or Guardian reports so far ...

Maybe I should have been a bit clearer.

He has won his appeal as to whether the libel was a question of opinion or fact.

It has been determined to be a question of opinion so the defence of fair comment, as opposed to justification, is available.

That's still a massive decision to get but he's only halfway there. The case may still go to trial.

It'll be interesting to read today's ruling.

The judges who chose to sit on it are the real big hitters of our judiciary - Lord Chief Justice Lord Judge, Master of the Rolls Lord Justice Neuberger and Lord Justice Sedley.

I wonder if any of them will have any choice words for Eady.

Hats off to Singh for pursuing this. The BCA would be very unwise to continue the case now, surely? I can't see any way they can win it if they have to focus on the evidence for their claims rather than accusations of knowing dishonesty in making them.

Extracted from an email from Simon Singh:

This is a small step forward for libel reform, but there is still a huge battle to be fought over the issues of costs, libel tourism, public interest defence, balancing the burden of proof, restricting the ability of powerful corporations to bully individuals (e.g., bloggers, journalists, scientists) and so on.

The General Election was called yesterday and the manifestos will be published in the next week, so we need one last push to persuade the major parties to commit to libel reform. Although we have already achieved a huge amount (from editorials in all last week’s broadsheets to the Commons Select Committee recommending libel reform), we must keep up the pressure!

Both the Labour and Conservative parties have made encouraging sounds about libel reform, but now is the time for them to make commitments in their manifestos.

What you can do today to pressure politicians

I have spent over a million minutes and £100,000 defending my article and my right to free speech, so I am asking you to spend just one minute and no money at all persuading others to sign the petition for libel reform at www.libelreform.org/sign

The last time I made this request, we doubled the number of signatories from 17,000 to 35,000. Can we now double the number from almost 50,000 to 100,000?!

You could ask parents, siblings, colleagues or friends to sign up. You could email everyone in your address book. You could blog about it, mention it to your Facebook friends and Twitter about it. In fact, I have pasted some possible tweets at the end of this email – it would be great if you could twitter one, some or all of them.

You could forward all or part of this email to people or just steer them to www.libelreform.org/sign. Or you could persuade people that English libel law needs radical reform by using some of the reasons listed at the end of this email.

Remember, we welcome signatories from around the world because English libel law has a damaging impact globally.

Please, please, please apply maximum pressure to the politicians by encouraging as many new signatories as possible. Please do not take my victory last week as a sign that the battle is over. My case is still ongoing and the campaign for libel reform is only just starting.

Just read the judgment on the Jack of Kent site - it does seem very well thought-out.

A rather brilliant example of 'doing a Streisand' from the BCA. Good work lads. :D

Im off to see my chiropractor this afternoon...he's done wonders for my back. :D
There's a modest body of evidence that it might be helpful for backs. That is not what the offending article is about, although the fallout will inevitably be a lot of people assuming otherwise. They've really shot themselves in the foot with this one. "We thought we had a case when the claim was that we are dishonest, but not when the claim was that we are scientific incompetents". They should sue their lawyers for taking the case.

I've only skimmed the thread, but:

I used to go to BNI breakfast networking sillyness and there was a McTimony Chiropractor in the group who said in a presentation that he could help autism!
I had to be held back by a friend from jumping up and shouting charlatan!
However, in the past I was helped after I fucked my back moving a piano.

Simon Singh, thank you.
