Not using insurance following a road traffic accident - advice please...

when that might have been an option for me,

yes, it would have needed re-MOT-ing

but before that it would have needed something else to prove it really was the car i said it was (i guess it's a possible dodge to buy a pile of bits from a scrapyard, and try to launder a stolen car on the identity of a write-off)

and they said that future insurance would be difficult and they would only insure it third party

have the rules about this sort of thing changed?
Yeah, you don't need that anymore (Vehicle Identity Check).

Insurance write off categories have changed too.

Nah. Go on AskMID and find out. Even that only tells you if the car was insured, not the driver. IMO with someone who behaves like this, there's a fair chance they've something to hide, not that you'll necessarily find out.

Haha. No.

I mean, it depends what area and how busy. But unless they attended and did checks on the people involved, no way would police round here be so proactive as to check insurance on a third party traffic accident report.
I just checked on that site and the car has insurance.

That's good then. The insurer has to pay out even if it was nicked (not that I'm suggesting it was). The only thing that might happen is the driver denies what happened and/or blames you.

If it's his fault no, your insurance company will have lawyers on the payroll if needed. Check your policy even if he turns out to be uninsured, many insurance companies will not reduce your no claims for a hit and run invovling an uninsured driver. (In which case you will get the added satisfaction of knowing the insurance company will dob him into the plod)
Ask your union lawyers by all means but they will just say contact your insurance company.

There is no doubt it was his fault, although the only witness I have (other than two small children) is the friend who was in my passenger seat.

Recently, a silly young man driving a mercedes benz drove straight into the side of my car. Thankfully, none of us were hurt (I had my grandchildren in the car at the time!) but the car has been dented on the passenger door and the front wing.

The young man doesn't want to go through insurance because his premiums will shoot up, but he is being a bit of a pain about it all. Like, not trusting the quote I got from my local garage but wanting me to drive to his local garage at Mitcham to get it fixed.

Also, I will be without a car for at least 3 days, and could have got a courtesy car if I go through insurance.

Should I let him get away with this, and continuing working with him to get it fixed?

I have stood up to him and told him I am not going to Mitcham - but I have left it with him to contact garages local to me to see if he can negotiate a price that suits him.

He says he will pay for my taxi fares when I don't have the car, but how do I know he will pay up?

In fact, how do I know he will pay up for the garage?

Or should I just go for the insurance route? If so, how do I do that? Is it too late? It happened about 10 days ago.

I only have his name and phone number (and photo, but he doesn't know I have got that) and registration number.

Advice, please?

Insurance, like everyone else says. If he wanted an easy life he should've thought of that before he decided to drive like a twat. And if nothing else it could affect your own insurance if you've not reported a collision, even one where you weren't at fault.

Before making a decision, be aware that if you go through your insurance, your premium will almost definitely increase next year, even though it wasn't your fault, because, apparently, drivers who have had an accident, even a no-fault accident, are more likely to have another one.

Really? They can do that?

Your insurance policy will have a clause in it requiring you to inform them of all accidents regardless of whether you want to claim or not. Not telling them gives them the right to cancel your insurance, so I'd get on the phone tomorrow.

Plus next time you buy insurance they will ask you if you've been in an accident even if it wasn't your fault.

Or you could say nothing and get the money for the repairs from the other driver. (assuming the other driver is willing to pay up), because the other driver certainly won't be reporting it, by the sound of it. But if he isn't going to pay, then you have no choice but to go through the insurance,
