I used to deal with claims all the time where the driver absolutely refused to acknowledge they were at fault - whilst all the evidence indicated they were. Other insurance companies also know the law, whereas most people don't. A lot of people don't understand stuff like shared fault either.

Not everyone has the advantage of police training!

No it doesn't. That damage could easily have been done by hitting a stationary object whilst going round a corner "a bit wide" :rolleyes:

Best example I can think of is a situation like a shunt.. where you were pushed into the back of the car in front of you, after you were hit in the rear.

You would be at fault for hitting the car in front, because you should stop far enough away from it.. the driver behind would be at fault for hitting you.

I know. And not all insurance company staff have a fucking clue what they are talkig about. I had an (alleged specialist motorcycle) insurance company telling me it was "illegal" for a motorcyclist to filter past stationary traffic ...

If you are describing a situation in which you have stopped in traffic, in a perfectly normal position in relation to the car in front, and you are stationary when hit from behind, then how are you at any fault at all?

The car you hit may claim off you, and it may be for you to claim off the one who hit you, but in terms of amount you should not be held at fault at all.
