I think if you throw the car keys away until you're sober and never go over the limit again, it could be justified on the grounds that you've learnt your lesson.
The interesting thing is that, here in the US at least, people who are caught generally fall into two categories: people who drive drunk once or twice, and people who do it chronically and are usually also alcoholics.

Most stats show that people in the first group who are caught and fined generally have the living crap scared out of them by the experience, and don't drink and drive again.

Most people in the second group, however, continue to drink and drive, no matter what you do to them. You can fine them, take away their license, even give them jail sentences, and if the alcoholism or other underlying issues aren't dealt with, they will still drink and drive.

This combination of circumstances makes it very hard to design appropriate penalties. If you make the penalties extremely draconian, even for a first offense, many people argue that this is too harsh for those in the first group who are receptive to the lesson of their first bust. On the other hand, if you don't have very harsh penalties (long jail sentences, physically taking someone's car away), then the folks in the second group are likely to just go on drinking and driving and putting everyone else at risk. Personally, if i were in charge i would err on the side of harsher punishments, because even the people who only do it once or twice know that it is illegal and dangerous, and that they are putting other people's lives at risk.

The problem with penalties like taking someone's license away is that it is so hard to monitor, and the chances of someone getting caught for driving on a suspended license are very low. Studies i've read suggest that anywhere from 70-95% of people with suspended or revoked licenses simply continue to drive, knowing that they're unlikely to be busted.

If you get tugged you have to blow again at the station. Between 35 and 50 and you walk away with a caution, over 50 you get done.

If you're way over 50 the breath reading is sufficient to do you. A little over 50 you can opt for a blood test, (piss tests are only for haemophiliacs and shit).

If you opt for the bloods, fall off your chair whilst waiting for the doctor to arrive and gash yer nut. The doctor will be duty bound to fix yer bonce, then he'll take some blood. However a doctor treating you for injury is not legally allowed to take your blood sample for drink driving purposes, so let it get to court and point out that your blood was unlawfully taken and you walk/drive free.

A lot of bother though. Best to just not get pissed and drive really.
