No. Did macdonalds wilfully conceal the commonly known fact that boiling water can cause major burns? No. There is, in any sane system, no case to answer for. Macdonalds obviously did nothing wrong. The claim that the water was 'superheated' is clearly a nonsense to anyone who has even the most basic understanding of science - water boils at 100 degrees celsius at sea level and cannot get any hotter. Filter coffee tastes best when a) made with boiling water and b) served as freshly as possible. How can doing that possibly be negligent?
