It doesn't really matter whether people can avoid it or not.
If somebody has committed a crime, they can be punished by the law for committing the crime. If they then get on the net and do it again, they can be punished again. If they've been convicted of making some huge sum from the redistribution of copyright material for money, I'm sure they could be punished quite severely. But denying some access to the net is now like denying them access to the phone, or to the postal service.

There was a big hoo haa haa (like to say that!) about RapidShare - lots of people use this instead of P2P stuff now - the whole site was threatened with closure in Germany.

Just use usenet with SSL encryption and your ISP is going to have a job on its hands.
It knows you're downloading a lot of stuff, but has no idea what it is your downloading. Should be able to find a few usenet providers with unlimited downloads and SSL for under a tenner a month. (Much quicker and safer than torrents anyway, IMO)

If you are lucky enough to get in the Scene then you are laughing. You don't even have to share with plebs on torrents. Get it straight off the box. I am, well, I review scene releases a day or two before they're released onto private torrents. However I always delete them as piracy is wrong and funds terrorism

The good private sites are zero hour these days.
Not at all, a good PT ideally has between 500 - 1,000 users or less and about 10% heavy users. You need a box that is capable of MB/s.

What, you're going to be kicked off your ISP for using the wrong port? BitTorrent is a legitimate form of distribution used for plenty of legitimate things. If you can't tell what's in the packets, you can't do anything about it.
