CRB check - will you always know one has been undertaken?

If you apply for a job can they do a CRB check without you knowing, or do you have to complete the forms and consent?
 
Phew! So you get the option of walking away rather than having your shameful past exposed in the middle of the office.
 
Yup, although even if it does come up with something your embarreased about your employer shouldnt be broadcasting it around the office.
 
You need to fill out and sign some pretty chunky forms with lots of detail about old addresses etc and sign stuff, I don't think it would be possible to have a workplace just do it on spec really...

the police can warn your boss off but your boss can't tell you at risk of going to jail himself.:eek:
which makes some sort of sense but if there's something wrong with your file nobody can tell you and your not allowed to see it :hmm:

I administer CRB checks for some of our staff and, unless theres a secret system the Government havent told me about, this is bollocks.

AFAIK theres no way of carrying our a CRB check without the subjects express consent.

I imagine this might be the case in a small town or summat, but wouldn't it be abuse of the PNC?

no, there is a provison in the CRB rules for the requestor's copy to contain information that wouldn't be put in the applicant copy in case it compromises an existing investigation
 
I'd suggest a look at www.crb.gov.uk

I am pretty darn certain that an employer can not run checks on an employee without their consent. (there may be exceptions for things like the armed services and MI5 and so on)

Also, CRB disclosures can only be requested for someone applying for / in certain types of work (paid or voluntary) - see http://www.crb.gov.uk/guidance/rb_guidance/eligible_posts.aspx

May be a red herring here, but there are levels of disclosure, some where 'spent offences' and information about things that never got as far as court can be disclosed (in the soham case, the police were criticised for not disclosing previous allegations) - this would only be for jobs with significant access to children / vulnerable people.

Also, from memory (I got out of the kind of job where I was doing criminal record checks just before the CRB came in) only certain authorised people within an employer are allowed to see the detail of the disclosure, and it is a criminal offence if one of those authorised people then passes on (or is negligent about security of) that detail.

you have to fill in the form for it.

if your stuck for work, fill it in and do the job for the next couple of weeks... or delay handing it in for 2 weeks... gets you extra pay before you leave saying "got another job"... had to do it before when i tried to get into a company who wouldnt exept any conviction. i didnt expect to have to do one for a help line job... luckily another organisation offered me a job that werent as fussh :) got 4 weeks drug and alcohol training then fecked off to the project that offered me a contract :)
