Contract Question

I wouldn't have thought that charities would use Workfare either, but they do.
Job Centre Plus offered the charity I work for Workfare placements. They had the temerity to complain to my CEO when I told them at a meeting to go and fuck off.
 
I got told off. Not for long though. The telling off centred on not coming across as a thug except when I really wanted to. He said that as he was a black bloke and I was working class, much of the sector would hate us both so we needed not to fall into their traps.
 
I personally did a project to get unemployed locals back into work. I have four on the team right now. They are some of my best staff. Job Centre Plus were incredibly arsey about my refusal to provide information on them. Forget indignant, they just refused to accept I could just refuse and laugh at them. They wrote to the local Council to lean on me, wrote to my board. It was fucking hilarious.

On the whole though, charities are not funny to work for.

I have been working part-time for a charity for just over 2 years.

Your length of employment may be crucial. There's a term 'custom & practice', which basically means that if you've been doing it for a while - and 2+ years definitely qualifies - and can demonstrate it, then that's your norm. I'm sure cesare can give chapter and verse. But basically, in theory, you could write up your current terms & conditions and insist that that's your employment contract.

But you need proper professional advice.

You have it in a nutshell. They also did not like the easy in method of applying. No forms, just me asking "are you unemployed?" Yes? Ok then.

If they want you to collect and disseminate data for them, they should be paying you to do it. More free labour, aye.
