Car towed. Do I have a chance? Please help.

When I lived on Rushcroft Road the parking enforcers were militant. When my mate parked his car there, they tried to lift his car before they'd even issued a ticket, and before he had even exited the vehicle.

He'd only been parked for under a minute

Tbf he was in the back of the car crouched down checking under the seats for a piece of hash he had dropped earlier, so they might not have seen him. :hmm: but still :D

one day soon I firmly expect to see the car liberation front mounting nighttime raids on car pounds to liberate the impounded cars from their evil captors

my only experience is with islington and they are just as bigger cunts. the only difference with them was then they towed your car they took it into the congestion zone. you not only had to pay to retrieve your car and pay your fine but then pay the fucking congestion charge as well. fuckers.

:D:D ouch! That really is insult to injury!!

It seems very arbitrary.
It is, in effect.

There are some thresholds over which a vehicle can be authorised for removal (or clamping) - usually longer periods of time offending, or multiple outstanding tickets or something like that (but differs between councils - some don't tow away at all, some do it alot).

Once authorised it becomes chance - is there a tow-truck available. They prioritise them to vehicles causing serious obstruction or danger but, after that, they just work their way through the list of what has been authorised and where they are / it is plays a big part in whether it is sooner or later.

That is a systematic problem which should be resolved. I suspect a judicial review of a decision to do that and not negotiate with TfL for a congestion charge exemption would succeed.

Take legal advice / appeal congestion charge!

Cheers. Suspected as much.

Ironic that theres so much resource available there and yet when I had a) a car and b) a driveway - both in Lewisham - it could take hours for anyone to come out to do something about the selfish gits parked blocking me in.

A while ago there was uproar on my estate because cars on the owners driveways were clamped. Also a disabled driver was clamped as he got out of the car to open the garage door. That was clearly corruption though because they took a cash backhander to waive the £400. Which is widely believed to be the case with a couple of broken down vehicles that had no permit and weren't clamped once in months.

My car was towed away in January this year. I appealed unsuccessfully, but then went to the Ombudsman. It cost me nothing to appeal, because I didn't use any lawyers. I nearly didn't bother with the Ombudsman, because I was really busy with work and life, and wasn't sure if it was worth the effort, but the charge was £260, which I really could not afford, so I did it, pretty much at the last minute.

I was sent a letter telling me the court date, and asking me if I wanted to attend, which I was kind of fretting about, and thinking I probably wouldn't bother.

I won because the council decided not to contest the case, and I have been told since that this is pretty common, because it costs them more than £260 to fight a legal case, so they just repaid me the full amount, including the £60 parking ticket.

So, it's worth appealing.

Having said that, though, my case wasn't quite as clear cut as the one in the OP, so the Council may want to go for it.

I saw cars get ticketed at 3am last Saturday morning!

In the small hours, a Lambeth Parking Enforcement vehicle cruised up Railton Road. They found a couple of cars parked out of the way on a section of very wide, otherwise unused, pavement at the end of Barnwell Road. It's three o'clock in the morning; the cars will be gone by 5am, because Mingles will have shut by then. But they booked the cars anyway (no, they didn't ask Mingles to make an announcement to their customers to move the vehicles).

The small hours of a Saturday morning are hardly busy, but I guess if you've been sent out to work at that time, you've got to show results.

Are you talking about private parking enforcement on private property?

It sounds like the property owners have handed over all control to the parking enforcement contractors who offer to provide the service for free and make all their money from tickets / clamps / removals.

Hence they have a direct motivation in issuing dodgy tickets, etc.

The responsibility for enforcing the law of trespass lies with the property owner. If they CHOOSE to abandon all responsibility for how it is done to some cowboy parking contractor THEY should be held to account for that decision and they should certainly not be allowed to deny any responsibility for the behaviour of the cowboys. They are just as responsible as the cowboys and, to be honest, I think a lot of the ire directed at the cowboys should be directed at the property owners who let them loose in the first place, especially when those property owners are the landlords of flats and businesses where most of the targetted vehicles come from.

Write to or email Steve Reed, leader of Lambeth council - I did that once and got my mother-in-law's tow fine rescinded to a ticket in very similar circumstances to yours.

Acknowledge that you deserve a ticket, but point out what antisocial behaviour it is for Lambeth to tow cars off quiet sidestreets within an hour of parking restrictions opening.

Good luck.

I dunno how easy it is to move house by bus  I guess it depends on how much stuff you have.

I have moved house by bus twice and have a fair bit of stuff. First time was from West Dulwich (Crosted Road) to Norwood road (Tulse Hill end) which required the services of the Number 3 bus and the Number 68 or 468 but only set me back £3.80 for a day pass.

The second was easier which was from Norwood Road to Herne Hill (top of the Hill) which only involved a No 68 or a 468.

Both occasions I were too skinto for a man with a van and I must say it took most of the day. Very good way of moving for people who don't mind buses.

I found that out of six number 68 bus drivers, only one would let me take my bed on board

cant see the post i was looking for complaining about the council taking hours to remove the cars blocking his drive...... This used to happen to me a fair bit, i just used to bounce the cars out of the way.

Also i think if the text in the sign is under a certain sign it might not be in compliance with the DSA. That might be a final route to look at if it aint gonna happen any other way.
