For the situation you are talking about, it was yet another fuck-up by the FA, Everton should have never been allowed into the champions league, but they whinged about Heysel etc and this happened:

APparently there have been players in the EPL before who were owned by a third party - Portsmouth had a similar arrangement not long ago. The only difference is the specific clause, which stood only to harm us, not help us (the clause said that kia could take the player out of the club at any time). How on earth that benefitted us is beyond me. And as for people saying that other clubs could do the same thing in future - fine, if they also want a clause saying that a player can be taken out of the club at any time. That is the only time they could be committing the same offence.
